Former President Goodluck Jonathan, according to human rights lawyer Mr Femi Falana, SAN, will be unable to run for president in 2023 owing to the constitution.
Jonathan had been linked to a switch to the All Progressives Congress, APC, in recent days, according to media sources.
If he joins the ruling party, he is seen to be capable of winning the party’s presidential nomination.
Falana, on the other hand, referenced Section 137 (3) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) as proof that Jonathan is ineligible to run for president in 2023.
“It has been established that former President Goodluck Jonathan has decided to join the All Progressives Congress, APC, to fight the 2023 presidential election,” Falana stated in a statement.
The former President, however, is barred from running in the election under Section 137 (3) of the Constitution of the Federal Republic of Nigeria, 1999, as amended, which states: ‘A person who was sworn in to complete the term for which another person was elected as President shall not be elected to such office for more than one term.’
